Terms of service

These Terms of Service (“Terms”) govern your use of toyliciouskids.com (the “Site”) and any purchases made from Toylicious Kids (“we”, “us”, or “our”). By visiting our Site or purchasing from us, you agree to be bound by these Terms.

Please read these Terms carefully before using our Site. If you do not agree with any part of these Terms, you may not access or use the Site.

Overview

Toylicious Kids is a small online shop based in Markham, Ontario, Canada. We sell curated kids products including apparel, feeding, play, and wellness items — sourced from brands we trust, primarily from Korea, Japan, and Canada.

We reserve the right to update, change, or replace any part of these Terms at any time by posting changes to this page. It is your responsibility to check this page periodically. Continued use of the Site after changes are posted constitutes acceptance of those changes.

Section 1 — Eligibility

By using our Site, you confirm that you are at least 18 years of age, or that you are using the Site with the supervision and consent of a parent or guardian. You may not use our Site for any illegal or unauthorized purpose.

Section 2 — Orders & Payment

  • All orders must be paid via Interac e-transfer within 24 hours of placing the order. Include your order number in the e-transfer message field.
  • Orders are not confirmed until payment is received and matched to your order.
  • We reserve the right to cancel any unpaid order after the 24-hour payment window.
  • Prices are listed in Canadian dollars (CAD) and are subject to change without notice.
  • We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be placed by resellers or distributors.
  • You agree to provide accurate and complete purchase information. We may contact you using the information provided at checkout.

Section 3 — Shipping & Delivery

  • In-stock items are processed within 1–5 business days of payment confirmation.
  • Pre-order items are processed when stock arrives from our supplier — typically 3–4 weeks after the pre-order window closes.
  • We offer local delivery within the GTHA, Canada-wide shipping, and porch pickup in Markham. See our Shipping & Pick-Ups page for rates and zones.
  • We are not responsible for delays caused by couriers or Canada Post once an order has been dispatched.
  • We do not ship to PO boxes or to Yukon, Northwest Territories, or Nunavut.

Section 4 — Pre-Orders & Soft Orders

  • Pre-orders require full payment upfront at the time of ordering.
  • By placing a pre-order, you are committing to the purchase. Paid pre-orders cannot be cancelled or refunded except in the event that we are unable to fulfill the order.
  • If we cannot fulfill a pre-order, a full refund will be issued.
  • Pre-order timelines are estimates. We will communicate delays as soon as we are aware of them.
  • Soft orders (feeler listings) require no payment and can be cancelled at any time before they convert to a pre-order. Once converted, pre-order terms apply.

Section 5 — Returns & Refunds

  • All sales are final. We do not accept returns or exchanges for change of mind or accidental purchases.
  • Refunds are only issued if we are unable to fulfill a pre-order.
  • We strongly recommend messaging us on Instagram @toyliciouskids before ordering if you have any questions about a product.

Section 6 — Products & Pricing

We make every effort to ensure product descriptions, images, and pricing are accurate. We cannot guarantee that colours displayed on your screen will exactly match the physical product. We reserve the right to correct pricing errors and cancel affected orders with a full refund. We reserve the right to limit quantities, discontinue products, or modify product offerings at any time without notice.

Section 7 — Marketing & Communications

We currently operate organically through Instagram (@toyliciouskids). We do not currently run paid advertising or use tracking pixels on our Site.

If you subscribe to our email list, you consent to receiving updates about new products, restocks, and promotions. You can unsubscribe at any time. We will never send marketing communications without your consent.

We may introduce advertising or analytics tools in the future. If and when we do, our Privacy Policy and these Terms will be updated to reflect that.

Section 8 — Prohibited Uses

In addition to other restrictions in these Terms, you are prohibited from using the Site or its content:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any applicable laws or regulations
  • To infringe upon or violate our intellectual property rights or those of others
  • To harass, abuse, defame, discriminate against, or harm any person
  • To submit false or misleading information
  • To upload or transmit viruses or malicious code
  • To collect or track the personal information of others without consent
  • To spam, phish, scrape, or crawl the Site
  • To interfere with or circumvent the security features of the Site

We reserve the right to terminate your access to the Site for violating any prohibited use.

Section 9 — Third-Party Links & Services

Our Site may contain links to third-party websites or services that are not owned or controlled by Toylicious Kids. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We are not liable for any harm or damages related to your use of third-party services. We encourage you to review the terms and privacy policies of any third-party sites you visit.

Section 10 — Intellectual Property

All content on the Site — including photos, text, logos, graphics, and product descriptions — is the property of Toylicious Kids or our content suppliers and is protected by copyright. You may not reproduce, distribute, modify, or use our content for any commercial purpose without our written permission.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Site or its content without express written permission from us.

Section 11 — User Comments & Submissions

If you send us feedback, suggestions, or other submissions — whether by email, Instagram, or otherwise — you agree that we may use that content freely without any obligation to compensate you or keep it confidential. You are responsible for ensuring your submissions do not violate any third-party rights or applicable laws.

Section 12 — Disclaimer of Warranties

Our Site and all products and services are provided “as is” and “as available” without any warranties or conditions of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is entirely at your own risk.

Section 13 — Limitation of Liability

To the fullest extent permitted by law, Toylicious Kids and its operators, employees, and affiliates shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, loss of data, or replacement costs — arising from your use of the Site or any products purchased through it.

Our total liability in connection with any order or claim is limited to the amount you paid for that specific order.

Section 14 — Indemnification

You agree to indemnify, defend, and hold harmless Toylicious Kids and its operators, employees, and affiliates from any claim, demand, or damages — including reasonable legal fees — arising out of your breach of these Terms, your violation of any law, or your violation of any third-party rights.

Section 15 — Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.

Section 16 — Termination

These Terms are effective unless and until terminated. We may terminate or suspend your access to the Site at any time, without notice, if we believe you have violated these Terms. All obligations incurred prior to termination will survive.

Section 17 — Entire Agreement

These Terms of Service, together with our Privacy Policy, Return Policy, Shipping Policy, and Pre-Order Policy, constitute the entire agreement between you and Toylicious Kids regarding your use of the Site. They supersede any prior agreements or understandings, whether written or oral.

Section 18 — Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ontario.

Section 19 — Accuracy, Errors & Omissions

We are not responsible if information on the Site is not accurate, complete, or current. We reserve the right to correct errors, inaccuracies, or omissions and to update or cancel orders if information is found to be inaccurate — including after an order has been submitted. We are under no obligation to update information on the Site except as required by law.

Section 20 — Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference.
